The new Clearinghouse Rule enforces strict consequences, and drivers can now have their Commercial Driver's License or Commercial Learner's Permit downgraded and be suspended from duty. Query drivers today to ensure there is no prohibited status in the FMCSA Clearinghouse.

The FMCSA Clearinghouse mandate is a new law that mainly impacts employers of CDL drivers.

Clearinghouse is a mandatory database with real-time information on drug and alcohol violations of CDL drivers. Employers, including owner-operators, must report such violations to the Clearinghouse.

As a motor carrier, you are required to set up a Clearinghouse Account and conduct queries on CDL drivers both annually (every 12 months since employment) and at pre-employment.

CLEARINGHOUSE REGISTRATION

The CLEARINGHOUSE is a federal database which collects, stores, archives and makes available for federal and state agencies data pertaining to CDL drivers' drug and alcohol test results. It is a centralized system which gives agencies, testing labolatories, state DOTs, state troopers and trucking companies access to a CDL driver's testing data. To enroll in Clearinghouse click here


The FMCSA requires all companies hiring CDL drivers operating vehicles at or in excess of 26,000 pounds to conduct annual queries in the FMCSA Clearinghouse.

Queries must be conducted at least once in a 12 month period.
The deadline to initially query drivers is set for January 5, 2021.

The Clearinghouse must be queried on all currently hired CDL drivers by the aforementioned deadline and at least every 12 months thereafter similarly to annual MVR record requests. If you need to request MVR records for your drivers click here: Motor Vehicle Records (MVR Application).

In order to query drivers a motor carrier must establish their Clearinghouse account and link it with the FMCSA Portal in order to track test data by its DOT number.
