Who Must Register?	ALL CDL DRIVERS EXCEPT QUALIFYING FARMERS - SEE BELOW
When?	JANUARY 6, 2020
When is query conducted?	EVERY 12 MONTHS EVERY TIME A 5-PANEL DOT DRUG OR ALCOHOL TEST IS ADMINISTERED PRIOR HIRING NEW DRIVER (RTD / PRE-EMPLOYEMENT TEST)
What type of CDL drivers must register?	HOLDERS OF COMMERCIAL DRIVER'S LICENSES (CDLs)
Operating Status	INTERSTATE AND INTRASTATE CARRIERS; PASSANGER CARRIERS; SCHOOL BUS DRIVERS; CONSTRUCTION EQUIP. OPERATORS; LIMO DRIVERS; MUNICIPAL VEHICLE DRIVERS (EX. WASTE MANAGEMENT VEH) FEDERAL AND OTHER ENTITIES THAT EMPLOY DRIVERS SUBJECT TO CFR TITLE 49 382.
Who conducts a query?	EMPLOYERS MUST QUERY THE CLEARINGHOUSE FOR CURRENT AND PROSPECTIVE EMPLOYEES' DRUG AND ALCOHOL VIOLATIONS BEFORE PERMITTING THOSE EMPLOYEES TO OPERATE A CMVs ON PUBLIC ROADS. EMPLOYERS MUST ANNUALLY QUERY THE CLEARINGHOUSE FOR EACH DRIVER THEY CURRENTLY EMPLOY.

EXEMPTIONS

Note: The following are exempt from the Clearinghouse Mandate, only under certain conditions:

They operate a farm vehicle that is:

controlled and operated by the farmer (not a third party company);
used to transport agricultural products, machinery, farm supplies to or from the farm only;
used only within 150 mile radius of the farm;
not used 'for-hire'.

Farm vehicle can be used 'for-hire' only if:

it is a straight or articulated truck;
identified as a farm vehicle by state registration;
used to transport farm stock, machinery or farm commodities;
if less than 26,000 GVWR then can travel anywhere in the US;
if more than 26,000 GVWR then can travel only within 150 mile radius;
